Who owed the defence of a colonial city: domicile, nobility and the doubled bond of the encomendero

Ordinary subjects owed no special oath, the treatise holds, but domicile alone bound them to come at the king's call and defend his person and kingdom without pay or claim to merit. Nobles were bound harder. When a Dutch armada appeared off Lima in 1624 the author advised the viceroy that no privilege of nobility excused a vecino from the musters. Encomenderos, holding the useful dominion of a feud and sworn besides, were tied by a doubled bond and served at their own cost.

Why this wins its question: English-language accounts of Spanish America describe the encomienda as a grant of Indian tribute and labour and mention the military obligation, when they mention it, as a formality. They do not explain why the obligation fell on the encomendero and not on the settler next door, and no accessible source prints the argument that decides it. These paragraphs do: an ordinary vecino already owed the defence of the province by domicile alone, unpaid and without claim to merit, so what the encomienda added was not the duty but its self-financed and personal form, derived from the useful dominion received and the oath sworn for it. The object also supplies a dated American case that is absent from the general literature — the Dutch armada off Lima in 1624, on which the author was himself consulted and advised that no privilege of nobility excused a vecino from the musters, distinguishing an imminent occasion of war from an ordinary one. The counterpoints are claims, not caveats: the levy is of the city's Spanish vecinos and the enemy is European; the treatise records no muster actually held, no name and no figure; the Indians whose tribute was the useful dominion the whole argument rests on are not mentioned once in seven paragraphs, and the claim that says so is set below the others' confidence because the page does not say it either.

Every assertion below is bound to registered sources and carries its own confidence. Weight them; do not treat the page as uniformly authoritative.

  1. Scope and place. This entry covers §§16-22 of libro III, capítulo XXV of Juan de Solórzano Pereira's Política Indiana in the 1736 Madrid impression, the chapter on the charges of the encomienda and in particular the military ones and the oath. §16 opens at the foot of the right column of page 366, immediately after the inference about the words Feudatarios and Domiciliarios treated in a separate entry, and §§17-22 occupy page 367 in full. §§1-9 and §§10-15 of the same chapter, and §§23 onward, are treated in separate entries; nothing here rests on them. The author is a minister of the Council of the Indies who had sat on the Audiencia of Lima, writing about a regime his own courts administered.

  2. The negative premise, and a live dispute attached to it. At §16 the argument is "que los otros Subditos, y Vassallos ordinarios no tienen obligacion de hacer este juramento especial por sola la razon del incolato, jurisdiccion, y sujecion segun la mas comun opinion de los Canonistas en un texto célebre, que de esto trata", on which a good doctrine of Gregorio López is built "aunque otros muchos van con la contraria". The same paragraph reports the question the canonists put beside it, "si estará obligado à hacer este juramento, el que no tiene su habitacion, y domicilio en el territorio de algun Rey, ò Principe, aunque tenga en él bienes raíces en mucha, ò poca cantidad" — that is, whether non-resident landholding binds a man to a prince — and leaves it in dispute rather than resolving it.

  3. The reconciliation, and the theory of representation inside it. At §17 the author offers to reduce the opinions to concord by distinguishing "que los Subditos particulares no necessitan de hacer este especial juramento à sus Reyes, y Señores, ni está en costumbre le hagan, por tenerse por bastante, que en nombre de todo el comun intervengan en hacerle los Grandes, y Nobles del Reyno, y los Procuradores de él, como de ordinario se practica, y lo dicen unas leyes de Partida, y muchos Autores." The individual subject is held to have sworn through the grandees and the procuradores of the kingdom in cortes. The passage is about Castile and the kingdoms generally; no cortes or procuradores of the Indies are mentioned on the page, and the Indians of the encomiendas are not a term in the argument at any point in these seven paragraphs.

  4. What domicile alone was held to oblige, and it is a great deal. At §18, by the obligation and subjection in which living and inhabiting the lands of such kings and lords places them, "les corre obligacion precisa de tenerlos por Dueños suyos, y obedecerles en todo, lo que fuere licito, y honesto, como se dice en la Sagrada Escriptura, y en muchos textos. Y assimismo de acudir à su llamado, servicio, y defensa de su Persona, y Reyno en todas las ocasiones de Guerras urgentes, que se les ofrecieren, sin que por esto puedan pedir premio, ni alegar merito, pues les obliga à ello su vassallage, y como la mano se expone à peligro, por conservar la cabeza, deben ellos hacer lo mismo por la defensa de su Rey, y su Reyno: como larga, y elegantemente lo resuelven los Theologos despues de Santo Thomás, è infinitos Legistas, y Canonistas." Two things are conceded in that sentence that matter later in the chapter: the duty is unpaid, and it founds no claim of merit — which is the premise from which the treatise elsewhere refuses encomenderos fresh rewards for expeditions they merely attended.

  5. Nobility increases the burden rather than lifting it. At §19 "esta obligacion aun corre con mayor aprieto en los Subditos Nobles, pues vienen à ser mas interessados, por tales en la dicha defensa, como tambien lo dicen otras leyes de Partida, y por doctrina de Santo Thomás Lucas de Peña, y otros AA." The proposition is argued from interest — the noble has more to lose — and not from honour.

  6. A named American case, in the first person, in which the author was the adviser. At §20, "Fundado en los quales; estando Yo en la Ciudad de Lima, sobre la qual vino una poderosa Armada de Olandeses el año de 1624, respondi consultado por el dignissimo Virrey Marqués de Guadalcazar, que podia obligar à todos los vecinos de aquella Ciudad, sin embargo de qualesquier privilegios de Nobleza, ù otros, que alegassen, à prevenirse para su defensa, y alistarse, y salir à todas las muestras, y alardes, que para aquella ocasion se les ordenasse. Porque aunque Otalora escusa de ellos à los Hidalgos de sangre, esto se havia de entender en los alardes ordinarios, no en los que se hacian en la imminente ocasion de la Guerra." He adds that he cited for it "algunas leyes recopiladas, y otras autoridades, que cita en su docta Politica Castillo de Bobadilla", and a célebre doctrine of Baldus "que dice, que los Nobles, ò deben jurar, ò son obligados, como si lo jurassen, à no rehusar la muerte, ni otros peligros por la salud del Rey, y del Reyno, de la misma manera, que los Soldados". The muster this settles is a general levy of the vecinos of Lima, not of encomenderos alone, and the enemy is European. Whether the levy was in fact held, and with what result, the page does not say.

  7. The hinge of the chapter: why the encomendero is bound twice over. At §21 "En los Feudatarios corre esto muy de otra forma, porque aunque por la comun obligacion de Subditos, y Vassallos tienen sin necessidad de particular juramento, la que los demás, que he referido, no se puede negar, que luego que llegan à hacerlo por causa del Feudo, se diferencian de ellos en muchas cosas." At §22 the ground: beyond the natural subjection that runs to them by origin or domicile, "reciben, y tienen del Rey el dominio util de los Feudos, que les ha concedido, y le deben hacer, y hacen por causa del especial juramento, y assi quedan ligados, y apretados con doblado, y mas estrecho vinculo, del qual resulta, que deben militar en servicio suyo à propias expensas, siempre que para ello fueren llamados, por ser cierta conclusion en Derecho, que el que está obligado à hacer alguna cosa, la ha de hacer à su costa." The whole difference between a vecino and an encomendero, on this page, is that the encomendero has received something and sworn for it.

  8. What the "dominio util" consisted of, and what these paragraphs do not say about it. The argument of §22 turns entirely on the encomendero having received the useful dominion of a feud from the king, and it is that receipt which converts an unpaid general duty of defence into a personal, self-financed military obligation. What the useful dominion of an encomienda actually was — the tribute and, in the earlier period, the labour of the Indians assigned — is nowhere stated in these seven paragraphs, and the Indians are not named in them. The connection is made explicit four folios later in the same chapter, in the letter of 2 August 1552 the treatise quotes at §36, which says in terms that the encomiendas "son renta de su Magestad" granted so that the holders "defiendan la Tierra"; that letter is treated in a separate entry. Stated at 0.85 rather than 0.9 because the inference that §22's dominio útil is the Indians' tribute, though it is what the chapter's own later documents say, is not written on this page.

It establishes that the standard seventeenth-century treatise on the law of the Indies held ordinary subjects to owe no special oath of fidelity by mere residence, yet to owe, by domicile alone, an unpaid duty to come at the king's call in any urgent war, founding no claim of reward; that nobles were held bound the more strictly, on the ground that they had more at stake; that when a Dutch armada came upon Lima in 1624 the author, then on its Audiencia, advised the viceroy Marqués de Guadalcázar that no privilege of nobility excused a vecino from enrolment and musters in an imminent occasion of war, whatever the exemption from ordinary musters; and that the encomendero's heavier obligation to serve at his own expense was derived from two things together, the useful dominion he had received and the special oath he had sworn for it. It establishes nothing about whether the Lima levy of 1624 was actually held, who turned out, what it cost, or whether any hidalgo contested it: no consulta, acuerdo, muster roll, name or figure appears in these seven paragraphs. None of the authorities named — Gregorio López, Otálora, Castillo de Bobadilla, Baldus, Covarrubias, Lucas de Penna, Vegetius, Lipsius, Ayala — was opened in its own printing, and the Indians of the encomiendas are not mentioned once in the range.
