Were encomenderos noblemen? The treatise cannot find a cédula that says so, and records that they had no jurisdiction over their Indians

The obvious inference from the encomendero's oath was that he ranked with the titled nobles of Spain. The standard treatise on the law of the Indies refuses to draw it: no cédula or municipal law of the Indies grants it, feudal law denies that a feud alone confers nobility, and Castilian lords of vassals who are not titled are themselves enrolled and arrested as taxpayers. The passage adds, in a subordinate clause, that encomenderos had no jurisdiction over their Indians.

Why this wins its question: Popular and textbook accounts treat the encomendero as a seigneur in all but name, a colonial lord with vassals, and the encomienda as a quasi-feudal lordship. The chapter of the standard treatise that tests exactly that proposition reaches the opposite answer, and no accessible source prints it: the crown's own jurist sets out the argument for treating encomenderos as nobles of Spain and then refuses it in the first person, because in a lifetime of the business he has seen no cédula or law of the Indies that grants it; he finds the feudists against him; and he adds, as a thing too obvious to argue, that the jurisdiction Castilian lords hold over their vassals is what encomenderos do not hold over their Indians. The object also prints what the grant did carry — honour, a seat in the royal tribunals and immunity from arrest for civil debt — and prints it as the author does, as a custom he found received rather than as a right conferred, together with the deflating Castilian comparison in which untitled lords are enrolled and arrested by their own vassals as commoners. The limits are claims, not caveats: no individual case of claimed nobility appears, the denial of jurisdiction is a subordinate clause rather than a holding, and the witness for the custom is a judge remembering his own court.

  1. Scope and place. This entry covers §§59-62 of libro III capítulo XXV of the 1736 Madrid impression of Juan de Solórzano Pereira's Política Indiana. §59 begins at the foot of the left column of page 372 and runs into the right column; §62 ends in that column immediately before the 1736 editor's numbered additions, which are treated separately. These four paragraphs are the fifth and last of the inferences the author draws from the military charge of the encomienda; the fourth, on remuneration, is treated in a separate entry.

  2. The inference is stated in full and then refused. At §59, "Lo quinto, y último podriamos inferir, y probar de lo referido, que pues los Encomenderos se encargan de la defensa de su Rey, y su Reyno, y hacen de ello el juramento particular de fidelidad, que se ha dicho, como los Feudatarios, Titulos, y Nobles de España, deben solo por esto, en recibiendo las Encomiendas, ser tenidos por tales, y gozar de todas las franquezas, y privilegios. The refusal is grounded on the absence of a document, not on an argument of policy, and the author states it in the first person.

  3. Feudal law is checked and found to point the other way. At §60, "Y mirado el Feudal, con quien voy nivelando las Encomiendas, antes hállo decissiones, y autoridades expressas, que dicen, que por sola la concession de el Feudo, aunque tenga en sí anexa jurisdiccion, no se adquiere Nobleza; si no es de aquellos, que se llaman Feudos Nobles, ò se les dé este privilegio en la investidura, la qual haga algun Principe Soberano, que tenga potestad, y autoridad de conceder la Nobleza." The comparison with the European feud, which elsewhere in the chapter works in the encomendero's favour, is here reported as working against him.

  4. The Castilian parallel, and the sentence that says what an encomienda did not carry. At §61, "Y lo que es mas, lo mismo hállo resuelto por nuestras leyes, y AA. del Reyno en los Señores de Vassallos de Castilla, que no son Titulados, aunque tengan jurisdiccion sobre ellos, la qual no tienen los Encomenderos sobre sus Indios, porque no quedan Nobles por solo este Titulo: antes muchas veces acontece, que los mismos Vassallos los empadronan, y prenden, como à pecheros." Two things stand in that sentence. The lords of vassals in Castile who hold no title are not thereby noble, and are so far from being so that their own vassals enrol them on the tax lists and arrest them as commoners. And the encomendero is a weaker figure still, because the jurisdiction those Castilian lords do have over their vassals is precisely what he does not have over the Indians of his encomienda. The denial of jurisdiction is stated here in a subordinate clause, as something assumed rather than argued.

  5. What the grant did carry, as custom rather than as law. At §62, "Pero tampoco quiero negar por esto, que el tener en las Indias estas Encomiendas, y mas si son de las gruessas, dé, y cause mucha honra, estimacion, y autoridad, à los que llegan à conseguirlas. Y de aqui ha nacido la costumbre, que hallé recibida en ellas, de darles, solo por serlo, assiento en los Tribunales de las Audiencias, y Chancillerias Reales, y de no les prender por deudas civiles: porque para esto no requiere el Derecho muy exâctas probanzas de Nobleza, como ya lo dexé apuntado en el Capitul. XV. de este Libro, y lo repetiré en otros de los siguientes." Two real privileges are therefore recorded — a seat in the royal tribunals and freedom from arrest for civil debts — and both are put on the footing of a received custom which the author says he found in force, not of a grant of nobility.   6. The same privilege appears elsewhere in the work, extended to another body, and the two passages agree. In libro III capítulo XXXIII §20 the author records, again from what he says he saw in Peru, that the horsemen of the viceroy's guard were given a seat on the nobles' bench in the estrados of the Audiencia of Lima "como à ellos", that is as encomenderos were. The two passages are independent statements by the same witness about the same court, and together they establish that the seat was a recognised mark of standing in Lima; neither cites an instrument granting it.

  7. What this entry establishes and what it does not. It establishes that the standard treatise on the law of the Indies declined to hold that an encomienda conferred nobility, and did so because its author had found no cédula or municipal law of the Indies granting it; that feudal authority was checked and held to deny nobility to the mere concession of a feud even where jurisdiction was annexed; that the same was held in Castile of untitled lords of vassals, who were themselves enrolled and arrested as taxpayers; that encomenderos, on the treatise's own statement, had no jurisdiction over the Indians of their grant; and that what the encomienda did carry in the Indies was honour, a seat in the Audiencias and freedom from arrest for civil debts, all three described as a custom found in force rather than as law. It establishes nothing about whether encomenderos claimed or were awarded hidalguía in individual cases, which these pages do not discuss; nothing about how the absence of jurisdiction worked in practice, where the encomendero's power over his Indians was economic and personal rather than judicial and is treated elsewhere in the work; and nothing about capítulo XV, which is cross-referred and was not opened. The observation about the custom of the Audiencias is the author's own recollection of a court in which he sat as a judge, and no cédula or auto acordado is cited for it.
