1. The treatise grounds the practice in a procedure, and says what that procedure was. §8 of Política Indiana libro I capítulo XI, in the right column of page 44 of the 1736 Madrid impression: "La qual inteligencia se tuvo en aquel tiempo por tan segura, assentada, y notoria, que los Reyes Catholicos, haviendo sobre ello precedido, como es de creer, muchas consultas de sus Consejos, y Consejeros, y de otros gravissimos Theologos de dentro, y fuera de España, que sobre esto les dieron su parecer, no dudaron, de que justa, y legitimamente podian en virtud de ella, hacer las dichas conquistas." The hedge "como es de creer" is the page's own: the consultations are inferred by the author, not documented by him here.

The document is named, its purpose stated, and its author given on Herrera's authority. §8 continues: "Y assi en una notable Carta, ò Protestacion, que ordenaron, para que se leyesse, è intimasse à los Indios, antes de llegar à hacerles guerra, ni daño alguno: cuya nota dice Antonio de Herrera, que fue de aquel docto, y gran Jurisconsulto de su edad, Doctor Juan de Palacios Rubios, que tan estimado es por sus escritos aun de los Estrangeros." The instrument later known as the Requerimiento is here called a letter or protestation; the treatise gives it no date, no place of first use and no name of its own.

What the text claimed is quoted, in italic, and the claim is universal. §8: "Entre otras cosas, que les mandaban decir, y advertir, era, que llevaban esta concession Pontificia, y que el que se la havia dado, era Cabeza de todo el Linage Humano" — and, closing the same italic passage — "porque Dios le havia dado todo el Mundo por su servicio, y jurisdiccion." The clause between those two, which extends the pope's headship to men of whatever law, sect or belief and wherever they lived, turns on a word this impression prints ambiguously at the right edge of the leaf and is deliberately not transcribed here; the two pieces quoted are legible at word level and carry the assertion. The proposition put to people who had never heard of the papacy was that its holder was head of the human race by divine grant of the whole world.

4. The treatise does not print the text, and it says exactly where a reader can find it. Footnote (8) to §8 reads: "Herrera decad. 1. lib. 10. cap. 27. pag. 346. extat ad literam. hæc protestatio in 4. tom: Sched. impress. pag. 226. & apud Me, d. cap. 24. n. 32. pag. 618. Herrer. d. decad. 1. lib. 7. cap. 14. decad. 2. lib. 1. cap. 4. & decad. 4. lib. 1. cap. 8." The protestation stands verbatim, it says, in tome 4 of the printed cedularios at page 226, and in the author's own Latin work at page 618. None of those three printings was opened for this entry, so what this entry carries is the treatise's report of the document and not the document.

The argument that follows makes the title proof against its own possible defect. §9: "Y assi, yendo, como iban con buena fé, y fundados en este titulo, de mas de los referidos, y que por él estaba la autoridad, y observancia de la Iglesia Catholica, y Vniversal, y que precedieron pareceres de tales Consejos, y Consejeros: bien se dexa entender, y conocer, que en la adquisicion de estas Provincias, y mucho menos en su retencion no se debe, ni puede formar duda, ni escrupulo: quando aun despues de adquiridas, se entendiesse, que el titulo havia sido menos bastante." Good faith at the time of acquisition is made to answer a later finding that the title was insufficient — the move the same chapter develops at length from §11 onward under the name of prescription.

The second argument removes the question from anyone's competence to reopen. §10: "Fuera de ser cierto, que en materias opinables, qual esta lo era, à la Sede Apostolica pertenece declarar, la que se debe guardar, y seguir, como aqui lo declaró con el hecho mesmo, y no se permite à nadie reclamar, ni bolver à poner en duda semejantes declaraciones: especialmente revalidadas yá, y como autorizadas, y prescriptas con su vso, y larga observancia, ò con la possession, que en virtud de ellas se ha ido continuando con buena fé, y por transcurso de largos tiempos." That §10 concedes in passing what §2 had already conceded — that the matter was "opinable" — is what makes the closure argument necessary at all.

7. The same treatise sets a limit on the doctrine a few pages earlier, and its eighteenth-century editor sets another. Libro I capítulo X §16 of the same volume is the author's refusal to hold that infidels may be forced to accept the faith or dispossessed for refusing it; and at the foot of page 38, where the chapter on the title of infidelity opens, the 1736 editor prints over his own abbreviated signature that to keep the Indians in their liberty "ay un titulo, entero, que es el 2. lib. 6. Recop." Both are registered in this corpus from the preceding chapter. Neither cancels §8: the Castilian treatise still reports the letter as the regular preliminary to attack, and the 1736 impression still reprints it.

8. What this entry establishes and what it does not. It establishes that the standard treatise on the law of the Indies, in the chapter on the right acquired by the bull, recorded the existence of a letter or protestation ordered to be read and intimated to the Indians before war; attributed its drafting, on Herrera's authority, to Juan López de Palacios Rubios — the same jurist its previous paragraph names first among the defenders of absolute dominion, and the man this corpus's entry on the sermon of Montesinos records as the crown's answer to that sermon; quoted part of its content in italic; and pointed the reader to three printings of the full text. It does not establish the wording of the Requerimiento, its date, the language it was read in, whether it was interpreted, or what any hearer understood: none of that is on these pages, and none of the three printings cited was reachable from this container. It establishes nothing about how often it was read or with what effect.
