The code of the Spanish Indies gives the royal ninths of the tithe and the vacancies of bishoprics a título to themselves, and it is two laws long. In the fourth impression, printed at Madrid in 1791 by the widow of Joaquín Ibarra for the Royal and Supreme Council of the Indies, the heading "TÍTULO VEINTE Y QUATRO. DE LOS NOVENOS, Y VACANTES DE OBISPADOS." stands at the head of the leaf printing folio 578, so nothing of the preceding título stands on it; both laws end well above the foot of the leaf, whose lower third is blank, and the following título, on public auctions, opens at the very head of folio 579. The running head prints the número as "Libro VIII. Título XXIIII.", in the four-minim form, and was read at band magnification against the heading spelled out below it.

The first law states where the crown's share of the American tithe comes from, and it is not a tax but a division. Ley j (Charles V, Madrid, 3 September 1539; Philip II, 21 June 1562 and 17 July 1572; Ordenanza 34 of 1569) recites that it is already ordered by ley 24 and following of título XVI of libro I that the royal officers collect and keep account "de los novenos, que á Nos pertenecen por las erecciones de las Iglesias en la division, y aplicacion de los diezmos". The two ninths are the crown's portion under the foundation charters of the American churches themselves; this corpus holds the division they come from in the tithe título of libro I, where three further ninths of the same half are assigned jointly to the cathedral fabric and the hospital.

The same law records, as the reason it was needed, that the crown had been giving those ninths away. It orders the royal officers to charge themselves with the novenos in their books, "poniendo particularmente lo que montan, y de que proceden, formando cuenta particular de lo que importaren cada año, y lo introduzgan en nuestras Caxas Reales" — and then the concessive clause that carries the subject: "aunque hayamos hecho, ó hagamos merced, y concesion de ellos para fábricas de Iglesias, Hospitales, limosnas, y obras pias". The destinations are named in the statute in that order: the building of churches, hospitals, alms and pious works. What the law regulates is a stream of tithe money already flowing to them.

What the law actually requires is a detour through the royal chest, and it is the whole point of the enactment. Even where the ninths have been granted to churches, alms or pious works, it is the crown's will "que despues de introducidos en nuestras Caxas, y habiéndolos de haber algunas Iglesias, limosnas, ú obras pias, á que los hubiéremos aplicado, los dichos nuestros Oficiales hagan libranza, y paga de ellos, conforme á la concesion, y tiempo contenido en la merced, y no de otra forma, pena de nuestra merced, y cincuenta mil maravedís para nuestra Cámara". A hospital or a church fabric with a royal grant of the ninths could not be paid at the source: the money had to be entered, accounted and then issued by warrant against the terms and the term of the grant, and the officer who short-cut the sequence was fined fifty thousand maravedís.

The second law takes the income of every vacant see in America across the Atlantic. Ley ij (Ordenanza 38 of 1579; Philip IV, 23 June 1627 and Madrid, 3 December 1631) orders the royal officers to remit all maravedís in their hands proceeding from vacancies of archbishoprics and bishoprics of the Indies "pertenecientes á los Prelados, desde el dia de la vacante, hasta el que su Santidad hubiere dado el fiat á sus sucesores", at the first opportunity, to Spain, into the hands of the Tesorero of the Council of the Indies, "por cuenta aparte, sin juntarlos con la demas hacienda nuestra" — both what has been collected for time past and what is collected later. The vacancy is defined by two dates that no one in America controlled: the day the see fell empty and the day the Pope issued the fiat to the successor.

The same law explains what the money was for once it had arrived in Madrid: the Tesorero of the Council is to comply with and pay "los maravedís, y limosnas, que Nos hubiéremos hecho de ellos á Conventos, Comunidades, y personas particulares", and the American officers are to do their part "con precision, y puntualidad, sin excusa, ni dificultad, ni aguardar otra órden nuestra, entre tanto que no la diéremos contraria, ó diferente", advising the Council of every sum remitted "para que se haga cargo al Tesorero". The charity the vacancy income funded was therefore granted in Spain and disbursed in Spain, out of revenue raised from the tithes of American dioceses, and the accounting control is a charge entered against a treasurer in Madrid.

The two laws of the título pull in opposite directions and both are on the record here. Ley j is a solvency and audit rule that protects grants already made to American churches, hospitals and pious works by forcing them through a book and a warrant, and it is the stronger of the two for anyone who wanted a grant honoured after the grantor had forgotten it: a libranza "conforme á la concesion, y tiempo contenido en la merced" is an enforceable instrument in a way that a verbal assignment at the tithe barn is not. Ley ij takes a different kind of money — the vacancy income of a see, not the ninths — out of the Indies altogether. Nothing in the título gives any church, hospital or pious work a claim of its own: both laws address the royal officers, the penalty in ley j runs to the king's Cámara, and the entitlement in every case is the merced, which the crown made and could decline to renew. That reading of the two laws is this corpus's own; the título states no principle.

What this entry establishes is the text of two printed laws in the 1791 fourth impression, read from one leaf, and not what was collected, remitted or paid under them. No account of novenos, no libranza to a church fabric, hospital or pious work, no vacancy account of any American bishopric and no charge against the Tesorero of the Council appears anywhere in this corpus, so nothing here shows either law applied or evaded, and nothing here says what any of the mercedes the título presupposes was worth. The cross-reference to libro I título VII ley 37, on the vacancy, was not opened; the cross-reference to ley 24 and following of libro I título XVI is to the tithe título this corpus holds separately. Nothing here was collated against the 1681 first impression, which this corpus also holds.
